ABOUT THE WORKSHOP

With so much up in the air in this regulatory environment, one thing that remains constant is the need for a commitment to compliance. Therefore, a strong understanding of the continually shifting landscape is essential. More regulations? Less regulations? You and your compliance staff can handle it by using knowledge learned from attending the SDBA 2019 Compliance Workshop. The training is geared toward compliance professionals including those who may run their compliance program alone and/or wear many hats at the bank. 

This comprehensive day-and-a-half workshop, which will be held Oct. 15-16, 2019, at the Hilton Garden Sioux Fall South, will be led by Compliance Alliance. The workshop will cover deposits and operations topics to give a well-rounded view of the compliance landscape. Attendees will have extensive opportunities to network and discuss common issues with their community banking peers. Compliance officers, internal audit staff, and any employee who assists with compliance management, monitoring, audit, review or training should attend this training.

ABOUT COMPLIANCE ALLIANCE

Founded in 2011, Compliance Alliance is the only banking industry compliance resource that is owned, operated and managed by state bankers associations, including the South Dakota Bankers Association. Based on the needs of community bankers, Compliance Alliance provides its members an all-inclusive set of bank compliance tools and services that help them stay up-to-date with consumer and regulatory requirements.

1:30–2:30 p.m. 2019 Hot Topics
2018 was a crazy year in compliance. This presentation will act as a wrap-up covering the major compliance changes of 2018, what’s happening now in 2019, and provide information on the most frequently asked topics across our nationwide membership. We’ll discuss the changes to Reg CC, prepaid cards and possible legislation.

2:30–2:45 p.m. Break

2:45–4:00 p.m. Regulatory Panel
The Regulatory Panel allows face-to-face interaction with your regulators and highlights hot topics, trends and best practices. The question-and-answer session gives bankers an opportunity to get an up-to-date interpretation directly from the people who have been or will be in your banks.

4:00–5:00 p.m. SDBA Compliance Law Update
Join SDBA Legal Counsel Brett Koenecke, an attorney at law with May Adam in Pierre, S.D., as he discusses state-related issues and updates of interest in the banking compliance world.

PRESENTERS

Darlia Fogarty is director of compliance & COO with Compliance Alliance (C/A) in Austin, Texas. After 12 years as a  commissioned national bank examiner with the OCC, Fogarty developed an expertise in compliance while administering examinations in banks of all sizes. She also has 10 years of experience as a compliance officer/auditor and four years as a compliance/audit consultant. At C/A, Fogarty oversees the creation of tools and resources while also fielding questions from a wide range of regulatory and compliance issues.

 
 

Brett Koenecke is an attorney at law with May Adam in Pierre, S.D., and serves as legal counsel for the SDBA. He earned a B.S. with honors in economics from SDSU in Brookings and a J.D. from the University of Wisconsin-Madison. He has been in private practice in Pierre since 1995. Koenecke has lobbied the South Dakota Legislature for more than 20 years and has successfully represented many clients over that time. As a result, he has deep experience in many areas of law. Koeneke is a member of the State Bar of South Dakota and Wisconsin.

9:00–10:00 a.m. Fair Lending Top Issues
Fair lending continues to be a top priority for regulators across the board. It’s also an open-ended and interpretative set of requirements which the bank can unintentionally violate. During this presentation, we’ll cover recent enforcement actions and issues so your bank can avoid similar issues. This presentation will also cover the various aspects of fair lending—from what is considered a fair lending violation (even, or especially, inadvertent ones) to the regulatory and legal components for fair lending—ECOA and FHA.

10:15–11:15 a.m. S. 2155
This presentation addresses the top frequently asked questions related to the Economic Growth, Regulatory Relief and Consumer Protection Act and ongoing implementation concerns a year after the effective date for most of the requirements.

11:15–12:15 p.m. BSA Today
This session will cover real situations, findings and consent orders related to BSA/AML compliance and what we can learn from these orders. In addition, you’ll hear how your peers across the country are dealing with BSA/AML/OFAC compliance, including answers to frequently asked questions of more than 500 financial institutions.

12:15–1:00 p.m. Lunch

1:00–2:00 p.m. ADA Compliance
ADA compliance has been a hot topic in the last couple of years due to lawsuits related to website accessibility. This presentation will cover reasonable accommodation and also break down the Web Content Accessibility Guidelines (WCAG) into plain language for those of us who do not develop and build websites. 

2:00–3:00 p.m. CRA/Reasonable Expected Market Area
This session will compare the Community Reinvestment Act assessment area to the reasonable expected market area and how both impact your institution’s evaluation of meeting your community’s needs and in a fair lending context. We’ll specifically discuss how to define each area for your bank and the factors that go into making that delineation.

3:00–3:15 p.m. Break

3:15–4:00 p.m. Flood Update
This presentation will cover the frequently asked questions Compliance Alliance’s hotline staff get on flood, such as questions related to detached structure exemption, escrow notice requirements, force placement and required notices in respect to force placed flood insurance. This presentation will also cover the private flood insurance rules and common questions related to that requirement.
