Question of the Week

Does the bank have to comply with the appraisal independence requirements even if an appraisal is not required?

Answer: Yes—the bank should ensure independence in the appraisal ordering process even if the appraisal was not required by the appraisal regulations. Note that the bank should also follow the same independence requirements for evaluations.

SDBA Requests Information from Member Banks

The SDBA is calling on all member banks to participate in its annual State Banking Data Collection Survey--Making a Difference in Our Communities.

The Association requests that banks supply basic date for calendar year 2016, or for the most recent 12-month period for which the bank has data available. The SDBA will present the findings at its State Legislative Day on Feb. 8, 2017, in Pierre.

The SDBA is also requesting short narratives and photos of banks’ community service projects. If your bank has a community service project from this past year that you would like to be included, please submit a short narrative describing the project. If you have a photo of the project, email it to the SDBA.

The names of all banks that participate in the survey will be listed in the survey piece. All individual information will be kept confidential as to the amounts disclosed in any of the categories.

The survey link was emailed in late December to all member bank CEOs and those who completed the survey last year. If your bank did not receive the survey link, contact Alisa DeMers. View last year's survey.

Nichols: Banker Engagement Will Be Critical to Policy Wins in 2017

Grassroots engagement by all bankers will be critical in 2017 as the industry works to take advantage of a narrow window of opportunity to advance pro-growth legislation, ABA President and CEO Rob Nichols said during a webinar for bankers on Tuesday.

Acknowledging that the industry’s efforts to achieve meaningful regulatory relief would be “starting closer to the 50-yard line than the 5-yard line” with the new Congress and administration, Nichols emphasized that timing and bipartisan cooperation will be essential to scoring legislative wins. This is particularly true in the Senate, where 60 votes will be needed to enact any significant reforms. He added that the industry could see additional opportunities for “rule recalibration” at the supervisory level, as President-Elect Trump appoints new heads of several regulatory agencies over the next several months.

“Our endgame is to create a new supervisory framework to help banks better serve their customers, clients and communities,” Nichols said, noting that the key to success will be a forceful grassroots turnout. To that end, he urged bankers to attend ABA’s free Government Relations Summit March 20-22 in Washington, D.C., to lobby their representatives directly.

ABA EVPs Wayne Abernathy and James Ballentine also spoke on the call, offering more detailed outlooks for both legislation and regulatory policy. Listen to the webinar. Register for the Summit now.

ABA encourages bankers to send welcome emails to their lawmakers to express their interest in working together and position themselves as a go-to resource on banking issues. ABA has created a sample letter and online form that bankers can fill out with their contact information and send to their members of Congress. Send a letter now.

Credit Union Member Business Lending Bill Introduced

Reps. Ed Royce (R-Calif.), Jared Huffman (D-Calif.), Don Young (R-Alaska) and Peter DeFazio (D-Ore.) on Tuesday introduced an ABA-opposed bill (H.R. 389) that would exclude non-owner occupied, 1-4-family dwellings from the calculation of the cap on credit union member business loans. According to Royce’s office, the bill would boost credit unions’ member business lending by $11 billion.

The measure would come on top of recent actions by the credit union regulator--currently subject to litigation by the banking industry--to loosen the cap on member business loans.

ABA, the state bankers associations and bankers have successfully opposed similar legislation in previous Congresses, stopping an effort in the last Congress to tuck this measure into a spending bill. ABA will continue to resist efforts to expand the ability of tax-exempt credit unions to exceed their mission by reaching business markets already well-served by taxpaying community banks.
